General Terms and Conditions of Sourire GbR

§ 1 Scope

(1) These General Terms and Conditions apply to all orders placed by consumers through our online shop https://sourire-worldwide.com in the version valid at the time of the order.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity (§ 13 BGB).

§ 2 Contracting party, conclusion of contract, storage of the contract text

(2) The presentation of goods in our online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

(3) The order is placed in the following steps: 1) selecting the desired goods and clicking “Add to cart”, 2) reviewing the details in the shopping cart, 3) clicking “Proceed to checkout”, 4) entering the delivery and billing details and selecting the shipping and payment method, 5) reviewing the details again and correcting them where necessary, 6) bindingly submitting the order by clicking the order button. By clicking the order button, you submit a binding offer to conclude a purchase contract.

(4) Before submitting your order, you can correct your details at any time using your browser’s back function or directly at checkout, or cancel the ordering process by closing your browser.

(5) We will immediately confirm receipt of your order with an automatically generated email (order confirmation). With this email, we accept your offer.

(6) We will send you the order details and these GTC by email. You can access the GTC at any time at https://sourire-worldwide.com/pages/agb. For security reasons, your order details cannot be accessed via the internet. The contract language is German.

§ 3 Prices, shipping costs, payment, due date

(1) The prices stated are final prices and include statutory VAT. Shipping costs may be added. Shipping costs are displayed on our “Shipping & Payments” page and at checkout before the order is completed.

(2) The following payment methods are available: credit card (Visa, Mastercard, American Express), Apple Pay, Google Pay, PayPal, Klarna, SEPA direct debit, and payment in advance by bank transfer. The payment methods offered in individual cases may depend on the delivery country and the order value and will be displayed at checkout.

(3) For payment in advance, the purchase price is due immediately after the contract is concluded. The goods will be shipped after payment is received.

§ 4 Delivery

(1) The delivery time is 1 to 15 business days. The exact delivery time is specified in the product description for each product. For payment in advance, the period begins on the day after the payment order is issued to the transferring bank; for all other payment methods, it begins on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday, or statutory holiday at the place of delivery, the period ends on the next business day.

(2) Even in the case of sale by dispatch, the risk of accidental loss and accidental deterioration of the goods passes to you only upon delivery of the goods to you.

§ 5 Retention of title

The goods remain our property until full payment has been made.

§ 6 Warranty

The statutory liability rights for defects apply. In the event of transport damage or incorrectly delivered goods, please contact us with photos at info@sourire-worldwide.com. Your statutory rights remain unaffected.

§ 7 Right of cancellation

Consumers have a right of cancellation in accordance with the following cancellation policy.

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier takes or has taken possession of the last goods.

To exercise your right of cancellation, you must inform us (Sourire GbR, Corneliusstraße 110, 40215 Düsseldorf, Germany, email: info@sourire-worldwide.com) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model cancellation form for this purpose, although it is not mandatory.

You can also exercise your cancellation through our returns portal https://sourire-worldwide.returnista.com/ You can also register electronically. If you use this option, we will immediately send you confirmation (e.g. by email) of receipt of such a cancellation. You will also receive your return label in the portal.

To meet the cancellation period, it is sufficient to send the notification of exercising the right of cancellation before the cancellation period expires.

Consequences of cancellation

If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for the additional costs arising from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your revocation of this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the revocation of this contract. Please send the goods to:

The deadline is met if you dispatch the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to examine their condition, properties and functionality.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. This applies in particular to underwear (e.g. boxer shorts) in sealed packaging.

§ 8 Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
